Are You Tired of Dealing With The Insurance Company Adjuster?
A majority of the cases that our law firm has seen over the years are the types of cases where the injured party have exhausted their efforts to work it out with the insurance company. They are pretty much at their wits end trying to get the case settled with the insurance company claims adjuster. This is the point in which the potential client or family member will call our office and we get involved to try to help them get their case resolved with the insurance company and if the insurance company does not want to be fair, then we file a lawsuit on the injured party's behalf and hold the negligent party responsible.

Be Very Careful When You Talk To The Insurance Company.
Attorney Marc Sedwick is a former insurance claims representative and he knows that the adjusters are usually very well trained. One of the things your claims adjuster will usually want to do is to take a recorded statement from the injured party. We advise our clients not to provide a recorded statement. The injured party may tell the claims adjuster what has happened, but there is simply no reason to record it.

Another red flag to look out for is quick settlement offers.  For example, sometimes the insurance companies like to offer quick money to injured parties in hopes that they will accept it and be done with the claim.  Usually, in exchange for money, the injured party has to sign a release which is a document that pretty much says, again for example, in exchange for this payment I agree never to present a claim against the negligent party or his insurance company.  The problem with this is that when the insurance companies offer these quick type of settlements, usually they are made within a couple months after the incident.  And at that time, I have often seen that injured parties do not know the extent of their injuries. 

In the state of Indiana, for a motorcycle injury claim you have two years from the date of the incident to file a lawsuit.  We have received calls from injured people who took a check and then later found out that they would require more expensive medical treatment ultimately using up their settlement proceeds. We often recommend to our clients they wait at least six months to a year before presenting their claim to the insurance company. This is so that we know the full extent of your injury to protect your legal rights so that you receive absolutely all the damages you are entitled.
